Terms of Service
These Terms set the conditions for using PashaBen. Please use the Service only after agreeing to these Terms.
1. Scope of These Terms
- These Terms set the conditions for using PashaBen, including the web app, mobile app, APIs, AI question creation, image uploads, study features, minigames, battle features, billing, notifications, support inquiries, and related services.
- Users may use the Service only after agreeing to these Terms and any separate conditions shown in the Service.
- Minors must use the Service with consent from a parent or legal guardian.
2. Account Management
- Users must register accurate email addresses, external login information, passwords, display names, and other account information, and update them promptly when they change.
- Users are responsible for managing their accounts, credentials, devices, and sessions. Lending, transferring, selling, sharing, or impersonating an account is prohibited.
- If a user suspects unauthorized account use, leakage, or third-party access, the user must contact the Service promptly.
3. Service Features
- The Service provides features such as creating, storing, and organizing study cards; tag and folder management; image-based cards; study sessions; study records; game elements such as gold and items; minigames; battle features; profiles; notifications; and support inquiries.
- Some features, including AI question creation, OCR, image analysis, image moderation, billing, and push notifications, may use external services or cloud infrastructure.
- Features, specifications, usage limits, prices, supported devices, supported browsers, and available regions may change for operational or technical reasons.
4. User Content
- Cards, questions, answers, options, explanations, tags, folder names, images, images submitted for OCR, inquiry content, and other information created, entered, uploaded, or saved by users are called “User Content.”
- Users may submit or save only User Content for which they have the necessary rights, and must not infringe third-party copyrights, portrait rights, privacy, trade secrets, or other rights.
- Rights to User Content remain with the user or the lawful rights holder. However, the Service may use User Content as necessary to provide, store, convert, display, process with AI or OCR, moderate, support inquiries, investigate failures, prevent abuse, and comply with laws.
- Users should avoid submitting high-risk information that is unnecessary for study purposes, such as individual numbers, health information, financial information, confidential materials, or third-party personal information.
5. AI and OCR Features
- AI question creation and OCR features generate or assist with study cards, quiz questions, explanations, tags, OCR results, and related content based on submitted text and images.
- AI or OCR output may contain errors, inaccurate explanations, outdated information, incomplete content, or unintended expressions. Users are responsible for reviewing generated output and deciding whether it is appropriate for study or other use.
- AI output from the Service is not intended as professional advice for medical, legal, financial, career, exam-result, or other important decisions.
- Use of AI/OCR features is subject to ticket consumption, usage limits, membership limits, input limits, and other conditions shown in the Service.
6. Image Uploads and Moderation
- Users may upload only images suitable for study purposes, and must not submit illegal, harmful, sexual, violent, discriminatory, rights-infringing, privacy-infringing, or otherwise inappropriate images.
- The Service may check image safety, optimize file size, convert formats, check duplicates, isolate images for review, perform administrator review, delete content, issue warnings, suspend accounts, or take other necessary measures.
- Based on moderation results or administrative necessity, the Service may restrict display, delete User Content, limit use, issue warnings, process subscription cancellation before suspension, delete related data, or take other measures.
7. Prohibited Conduct
- Acts that violate laws, public order and morals, these Terms, Service guidelines, or rules of payment providers, app stores, or similar providers.
- Acts that infringe third-party intellectual property rights, portrait rights, privacy, reputation, credibility, trade secrets, or other rights.
- Posting, generating, saving, or sending illegal, harmful, sexual, violent, discriminatory, self-harm or crime-promoting content, spam, malware, fraudulent content, false information, or excessively abusive content.
- Using AI/OCR features to create content for rights infringement, exam misconduct, illegal acts, unauthorized acquisition of personal information, security violations, or other inappropriate purposes.
- Excessive load on Service servers, networks, databases, storage, external APIs, billing, or moderation systems; vulnerability probing; reverse engineering; unauthorized access; automated mass access; scraping; or bypassing restrictions.
- Fraudulently acquiring, modifying, transferring, selling, or converting membership benefits, AI tickets, gold, items, cards, accounts, notifications, coupons, or other rights or data.
- Any other act that the Service reasonably determines may disadvantage or harm the operation of the Service, other users, third parties, or external services.
8. Paid Features, Subscriptions, and AI Tickets
- Prices, content, terms, renewal, payment methods, cancellation methods, usage limits, and supported platforms for paid plans, AI tickets, and other paid features follow the conditions shown on purchase screens, final confirmation screens, app stores, payment provider screens, or other Service displays.
- The Service may use web payments, mobile app payments, app store payments, or other external payment infrastructure. Payment methods, billing, receipts, refunds, cancellations, and payment information management may also be governed by the terms of each payment provider or app store.
- Subscriptions may renew automatically unless cancelled by the user. After cancellation, paid benefits may remain available until the expiration date shown by the Service or payment provider.
- Consumable items such as AI tickets are consumed according to the conditions shown in the Service after purchase or grant. If communication failures, AI generation failures, payment reflection delays, or similar issues occur, the Service will review logs and, within a reasonable scope, regrant, return, correct, or otherwise respond.
- Except where required by law or separately approved by the Service, purchases are not refundable, returnable, convertible to cash, or transferable.
9. Notifications and Support Inquiries
- The Service may contact users through in-app notifications, push notifications, email, or other methods for service operation, important announcements, individual notices, image review results, AI ticket grants, incident information, inquiry replies, and similar purposes.
- When a user submits an inquiry, the Service may review the inquiry content, attached images, account information, usage status, logs, and related information as necessary for support.
- Push notifications and emails may fail to arrive, be delayed, or be duplicated due to device settings, network conditions, or external service specifications.
10. Data Storage, Deletion, and Account Closure
- Users may edit or delete cards, images, profiles, and similar data by the methods specified by the Service. However, logs and records necessary for legal compliance, abuse prevention, billing, refunds, audits, support inquiries, backups, and failure investigation may be retained for a reasonable period.
- Users may close their accounts through the specified procedure. After account closure, the Service will delete or anonymize data linked to the account, but may retain some information, such as payment records, audit logs, inquiry records, and moderation records, as necessary.
- If a user violates these Terms or abuse is suspected, the Service may, without prior notice, restrict use, delete posts, issue warnings, suspend or delete accounts, delete related data, contact payment providers, or take other necessary measures.
11. Intellectual Property
- Intellectual property rights for programs, screens, designs, logos, characters, images, text, audio, video, databases, documents, and other content provided by the Service belong to the Service or lawful rights holders.
- Users may use the Service for personal study purposes or within the scope approved by the Service, but may not reproduce, republish, sell, redistribute, modify, or analyze Service content without permission.
12. Changes, Suspension, and Termination
- The Service may change, interrupt, suspend, or terminate all or part of its features due to maintenance, failures, communication lines, external APIs, payment providers, app stores, cloud infrastructure, legal compliance, security responses, business decisions, or similar reasons.
- The Service will provide prior or subsequent notice where feasible, but may make changes or suspend features without notice when urgent or caused by external factors.
13. Disclaimers
- The Service does not guarantee users’ learning results, exam success, grade improvement, accuracy of AI output, completeness of OCR results, completeness of image judgments, permanent data storage, or continuity of external services.
- Users are responsible for User Content, generated output, study content, third-party rights infringement, and disputes between users or between users and third parties.
- Except in cases of intentional misconduct or gross negligence by the operator, the Service is not liable for damages caused by natural disasters, communication failures, external API failures, payment provider or app store failures, cloud infrastructure failures, maintenance, security responses, legal compliance, or user devices or network environments.
- Even if the Service is found liable, its liability is limited to the amount actually paid by the user to the Service in the month when the damage occurred, except where such limitation is not permitted by law.
14. Changes to These Terms
- The Service may change these Terms due to changes in service content, legal revisions, external service specification changes, or operational needs.
- For important changes, the Service will notify users through in-app notices, the website, email, notifications, or other appropriate methods.
- If a user continues to use the Service after changes, the user is deemed to have agreed to the revised Terms.
15. Governing Law and Jurisdiction
- These Terms are governed by and interpreted under the laws of Japan.
- If a dispute arises between the Service and a user, the court with jurisdiction over the operator’s location shall be the exclusive court of first instance.
16. Language
- The Japanese version of these Terms is the official version. If any translated version conflicts with the Japanese version, the Japanese version prevails.
